Part of Seven ecommerce SEO rules and ethics duties for UK stores
Ecommerce SEO analytics and UK data protection
Ecommerce SEO analytics can involve personal data. See how UK rules affect consent, crawler logs, retention and access requests.
What to take away
Ecommerce SEO data protection is the set of duties that apply when search work collects, stores or shares information about identifiable people.
- The UK GDPR and the Data Protection Act 2018 cover most store analytics data across the UK, not England alone.
- Consent is not the only lawful basissome analytics rely on legitimate interests, but record the balancing test.
- Googlebot verification is a security control, not a data protection control.
- PECR and UK GDPR both apply to analytics and cookie consent across the UK.
- Check whether you need to pay the ICO data protection fee, and keep a processing record, a retention rule and a route for access requests.
Where UK GDPR bites on store SEO
UK GDPR applies when you process personal data, which includes IP addresses, device identifiers and email addresses gathered through search and analytics. The UK GDPR and the Data Protection Act 2018 apply across the UK, including England; there is no separate England-only regime. The ICO is the UK regulator. Its Guide to Data Protection and guidance on cookies and similar technologies explain relevant duties.
If analytics or agency tooling stores data outside the UK, you need a transfer mechanism, such as an adequacy finding or the UK International Data Transfer Agreement.

Lawful bases for search analytics
Consent is not the only lawful basis. Legitimate interests can cover analytics that secure a store, prevent fraud or improve a service, provided you run and record a balancing test.
Consent vs legitimate interests
Consent
- Banner
- Specific, no pre-ticked
- Notice
- Explain purpose
- Objection
- Withdraw consent
- Record
- Consent record
Legitimate interests
- Banner
- Not required
- Notice
- Explain basis
- Objection
- Route to object
- Record
- Balancing test
Where you rely on consent the banner must be specific, and pre-ticked boxes or bundled acceptance fail that test. A legitimate interests notice must still explain the basis and offer a route to object. The cookie rules under PECR sit alongside UK GDPR and require consent before non-essential cookies are set.
The same disclosure discipline applies to paid placements and affiliate content, and our guide to an ecommerce SEO disclosure policy in England explains how to word the notice so the two documents agree.
Crawlers, logs and access requests
Search crawlers create server logs, and those logs contain IP addresses, so retention is a data protection question as much as a hosting one. Google publishes a method for verifying requests from Google crawlers that separates real Googlebot traffic from scrapers.
Verification is a security control and does not decide whether you may keep the log. Set a retention window, then aggregate or delete. A 30 day raw log window is an illustrative example, not a legal limit. A 14 month analytics retention period is one possible configuration, not a universal default; check the platform's settings and justify the period.
Access requests can arrive through any channel, including a review form. Give the team one logging route and one owner, because an export held by a contractor is still yours to answer for.
Other ICO duties for SEO teams
Check whether your organisation must pay the ICO data protection fee: use the ICO fee checker and check the ICO register of fee payers. An exemption may apply, so verify your position rather than assuming you are exempt.
Before introducing processing likely to create a high risk to people's rights and freedoms, assess whether a data protection impact assessment (DPIA) is required and complete it before processing begins. The ICO's DPIA guidance explains the assessment.
Have a route for handling personal data breaches and notify the ICO when a breach is reportable under UK GDPR. For subject access requests, log receipt, assign an owner and respond within the statutory time limit. The ICO's personal data breach guidance and right of access guidance explain these duties.
Using analytics tools in SEO work
For organic search work, Google Analytics 4 (GA4) can help measure activity on landing pages, while Google Search Console reports search performance. Set GA4's data-retention option to the shortest period that meets your documented purpose. Where non-essential analytics cookies require consent, configure consent controls before those cookies are set; Google Consent Mode does not itself obtain valid consent. Search Console does not use the GA4 site tag, so GA4 consent settings do not govern its reports; review its service-specific retention terms and restrict account access.
A team paying £400 a month for analytics tooling should treat it as a business expense, not a hidden data cost.
Who owns the process
Ownership usually sits with a data protection lead, not the SEO manager. The SEO manager supplies the purpose and the fields. The lead signs off the basis and the retention rule. Write that split into the role description so it survives staff changes.
What to record
Keep one page per tool: purpose, fields, basis, retention, recipients and review date.
Example record for an analytics tool:
Field / Example entry
- Purpose
- Measure organic search traffic to product pages
- Fields
- IP address, device ID, page URL, timestamp
- Basis
- Legitimate interests, balancing test recorded
- Retention
- 14 months for raw data, then aggregate
- Recipients
- Analytics processor and internal SEO team
- Review date
- 1 April 2026
Review it when you add a tag or change platform. The wider picture sits in our ecommerce SEO UK rules and compliance guide, worth reading before you redraft a privacy notice.

Common questions
Does UK GDPR apply to SEO agencies outside England?
It applies when an agency processes data about people in the UK on your behalf. Name it as a processor in the contract. An agency that sets its own purposes may be a controller.
Can I keep analytics data indefinitely for SEO trends?
No. Retention must be justified by purpose. Aggregate the data, set a review date and delete what you no longer need.
Is Googlebot verification enough to satisfy the ICO?
No. It shows a request came from Google, which is a security check. It says nothing about your lawful basis, retention or transparency duties.
Do I need a data protection officer for a small store?
Most small stores do not, unless processing is large scale or involves special category data. You still need an owner for requests and a written record. Individual cases need a qualified adviser.
